Property has started up the machinery of the plans of fiscal Inspection for this year with a special intensity. In the last weeks, one has communicated to the different equipment and units from the Inspection its objectives in 2008 in the persecution of the fiscal fraud. And the inspectors and subinspectors have stated an appreciable increase of the activities that must realize. “They have tightened the nuts”, commented union sources of these civil servants. According to their calculations, the objectives for this year have been increased more of a fifteen percent. The impression of the bodies of the Agency does not seem unfortunate, according to the documents to which it has had access EXPANSION. The increase of the control objectives of the fraud takes place in a context of weakening of the fiscal collection, by the economic deceleration. This month of January, the tributary income grew a 7.2%, half that in the same month of the past year. The smaller economic activity is being accused, especially, in the IVA: its collection fell 16.9% the first month of the year. The indicator of the activity of the Inspection is based on the number of homogenous activities that it must realize each equipment or unit, and on that, in addition, the productivity of the Inspection is moderate. The Tributary Agency has approved east New Year norms internal that regulate the calculation and the evaluation of the productivity of the tributary command teams, which they come to replace the previous ones, of 2005, which they were annulled by the National Hearing, to not to be negotiated with the unions - to see attached information. These norms (a Resolution of the director of the Agency, the 24 of January, and one Instruction of the person in charge of Inspection, of 12 of February) mark to the general criteria of distribution of the incentive of productivity for inspectors and subinspectors, based on the realized activities. In order to measure the task of the Inspection a complex calculation is realized in that considers different indicating and coefficients, like the number of investigated years, the volume of income of the contributor, if the investigation is general or it is limited some concrete tax and, mainly, in a fiscal number of debt to discover in each case. That is to say, that when the inspector investigates to a company of construction or a lawyer supervises, it considering that if it finds a determined number of fraud perceives bonus, and, on the contrary, it does not receive by productivity. Bonus that can suppose altogether between 15% and 20% of the total pay of the inspectors. The inspectors criticize this system, based on the attainment of an increasing number of activities, that go to the detriment of the quality and depth of the investigation. “In the end, to try to fulfill the determined objectives, they end up themselves realizing superficial activities, and the act company/signature is caused in conformity, to diminish the litigiosidad, which is damaging the image of the Inspection and the Agency”, they say. Sources of the Tributary Agency affirmed that “the objectives have grown like every year; always there are complaints, but in the end, they are ended up fulfilling”, they assured. The greater activity of the fiscal Inspection is not an exclusive situation of the central Property. Also the autonomies have tightened their control mechanisms before parón of the income. The regional coffers are very sensible to parón real estate. The autonomic collection by taxes directly related to the house, as the one of Transmisiones Patrimoniales (ITP) and the one of Legal transactions (AJD) has fallen in 2007 near a 11%. Against this background, the fiscal advisers assure that he has taken place a remarkable increase of the information requirements and files, especially for the control of the Tax of Patrimony. Only three days of negotiation with the unions For the first time, the Tributary Agency sat down in 2007 with the unions to speak of the payment of the productivity, a stock market of 85 million Euros, of where it leaves bonus the Inspection. The unions denounce the “minimum effort” of Property in this negotiation, that only lasted three meetings: first in February, second in March, and the last one, in December. And there was no agreement. Still more, the unions assure that in those meetings they did not treat the new approved norms this year by the Agency to regulate the distribution of the productivity of the Inspection. For that reason, they do not discard to raise a resource in the courts. Indeed, the effective regulation until now was annulled by the National Hearing, after a claim of union USO-SIAT, by not to have been object of negotiation with the representatives of the workers. This union also resorted the concrete distribution of bonus in the different provincial administrations from Property and, at the moment, it has obtained 19 failures to favor. The new Resolution of the Agency recognizes that “the recent legal doctrine” and the modifications introduced in the law of Budgets of 2008 in the norms of productivity distribution, have forced to reform their regulation.
